Estate of A.M. v. Schneider National. Pfaff & Gill, Ltd. was retained by the family of an older gentleman who was killed in a truck accident. The Schneider truck was traveling in the opposite direction and collided with a passenger car. The truck driver lost control, crossed through the grassy median, and collided with Mr. M’s passenger car.
The key piece of evidence turned out to be a survey of the scene performed by Schneider National within 24 hours of the collision. Pfaff & Gill, Ltd. knew from prior cases against Schneider National that Schneider ALWAYS performs a scene survey after a fatal collision. Schneider tried to hide the survey for two years, but after several court orders based upon the diligence and hard work of Pfaff & Gill, Ltd., the trial court struck Schneider’s answer and ordered a trial on the issue of damages only. The case settled shortly thereafter.
Estate of J.G. v. A Wisconsin Trucking Company. - $9,362,580 jury verdict for the estate of a 48-year-old man who was killed when a truck’s trailer backed into him, pinching his legs and causing fatal hemorrhages. The jury’s verdict included $8,800,000 in non-economic losses.
