The Schneider truck was traveling in the opposite direction and collided with a passenger car. The truck driver lost control, crossed through the grassy median, and collided with Mr. M’s passenger car.
The key piece of evidence turned out to be a survey of the scene performed by Schneider National within 24 hours of the collision. Pfaff & Gill, Ltd. knew from prior cases against Schneider National that Schneider ALWAYS performs a scene survey after a fatal collision. Schneider tried to hide the survey for two years, but after several court orders based upon the diligence and hard work of Pfaff & Gill, Ltd., the trial court struck Schneider’s answer and ordered a trial on the issue of damages only.
