Relief from the Waiver/Forfeiture Rule: Hux v. Raben and its Progeny

A careful lawyer might answer “when the party fails to properly raise the issue in the trial court.” That would be wrong. Due to the expansionistic views that some courts have shown in civil litigation, the correct answer can be “only when the reviewing court does not want to decide the underlying question.” Some lawyers perceive that reviewing courts arbitrarily choose to call an issue waived or not. Relieving a party from waiver or forfeiture in a civil case is unfortunate. A correct reading of the genesis of all these decisions in Illinois shows that the Hux doctrine has no substantive foundation in civil litigation and should be abolished.

Pfaff & Gill recently settled a product liability case against an auto manufacturer and a Chicago car dealership on behalf of their client, who suffered traumatic spinal cord injuries in a single-car motor vehicle accident.

Cook County Jury Returns $950,000 Verdict in a Medical Malpractice Case

$950,000 jury verdict in Circuit Court of Cook County, Illinois. Attorney Matthew D. Ports of Pfaff & Gill, Ltd. represented the plaintiff at trial 7/17/13-7/26/13 before Hon. Clare E. McWilliams.

Plaintiff, a 14-year-old minor, presented to Family Planning Associates on March 17, 2010, for an elective suction termination of pregnancy at 7-8 weeks.

Bruce R. Pfaff Inducted into the International Academy of Trial Lawyers

Bruce R. Pfaff, Esq., of Pfaff, Gill & Ports Ltd, in Chicago, IL was recently inducted into the International Academy of Trial Lawyers (IATL) at their Mid Year Meeting held July 17-21, 2013 in Chicago, Illinois.

The International Academy of Trial Lawyers limits membership to 500 Fellows from the United States. The Academy seeks out, identifies, acknowledges and honors those who have achieved a career of excellence through demonstrated skill and ability in jury trials, trials before the court and appellate practice. Members are engaged in civil practice on both the plaintiff’s and the defendant’s side of the courtroom, and the trial of criminal cases. The Academy invites only lawyers who have attained the highest level of advocacy. A comprehensive screening process identifies the most distinguished members of the trial bar by means of both peer and judicial review. Mr. Pfaff has been evaluated by his colleagues and the judges in his jurisdiction and has been highly recommended by them as possessing these qualifications and characteristics.

Chartered in 1954, the Academy’s general purposes are to cultivate the science of jurisprudence, promote reforms in the law, facilitate the Administration of Justice, and elevate the standards of integrity, honor and courtesy in the legal profession.

Medical Malpractice Case Verdict: Client Awarded Over $12M

J.G. v. Advocate Christ Medical Center – $12,261,171 jury verdict for the estate of a 49 year-old man who died from a rare blood disease, thrombotic thrombocytopenia purpura (TTP). He was admitted to the hospital on a Sunday morning, the diagnosis was confirmed by 4:30 p.m., but the plasmapheresis nurse took 6 hours to come to the hospital to provide the essential emergency treatment. His wife and three adult children survive him.

Bruce R. Pfaff Accepts Invitation to Become a Fellow of the International Academy of Trial Lawyers

Bruce R. Pfaff has accepted the invitation to become a Fellow of the International Academy of Trial Lawyers. The organization is limited to 500 Fellows in the United States under the age of 70. There are Fellows from more than 30 countries. The criteria for inclusion include outstanding skills and extensive experience as a trial lawyer, unimpeachable personal and professional character, integrity and honesty. Bruce looks forward to his induction at an upcoming meeting of the Academy.
