Pfaff, Gill & Ports, Ltd. first successfully took on Ford Motor Company in the early 1990s in a product liability case involving this type of seatback defect. Our client’s 1991 Ford Explorer was rear-ended in a crash and the driver’s seat broke. Although she was wearing her seatbelt, our client was thrown into the rear occupant compartment, hit the rear seat seatback, and suffered a permanent spinal cord injury.
A few years later, we faced Ford Motor Company again, along with Mazda Motor Corporation, when we represented the family of a man killed when his 1996 Ford Escort was rear-ended at a stoplight. His daughter, who was in the back seat on the passenger side of the car, fractured her legs, but survived the crash.
